The service

BLACK provides an AI receptionist that answers calls and messages, books appointments, and follows up with leads across your channels. Features and availability may change over time.

Accounts and eligibility

You must be able to form a binding contract and use the Service for a lawful business purpose. You are responsible for the accuracy of the information you provide and for activity under your account.

Fees and payment

  • The Service is offered as a one-time setup fee plus a recurring monthly plan, as described at checkout.
  • Fees are billed in advance and are non-refundable except as set out in our Refund Policy.
  • You are responsible for applicable taxes and for third-party platform and carrier costs passed through at cost.

Your responsibilities and acceptable use

  • You will provide accurate business information and keep it up to date.
  • You are responsible for obtaining any consent required to call or message your customers, and for complying with all applicable laws (for example telemarketing, messaging, and privacy laws such as the TCPA and CAN-SPAM where relevant).
  • You will not use the Service for unlawful, deceptive, harassing, or abusive purposes, or to send spam.

Third-party platforms

The Service connects to third-party platforms (such as phone carriers, WhatsApp/Meta, calendars, and CRMs). Your use of those platforms is also subject to their terms, and we are not responsible for their availability or actions.

Intellectual property

We retain all rights in the Service, our software, and our brand. You retain rights in your own business content and customer data.

Disclaimers

The Service uses automated and AI systems that may occasionally make mistakes. The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, or consequential damages, and our total liability will not exceed the amount you paid us in the three months before the claim.

Indemnification

You agree to indemnify us against claims arising from your use of the Service or your breach of these Terms, including claims relating to messages or calls sent on your behalf.

Termination

You may cancel as described in our Refund Policy. We may suspend or terminate the Service if you breach these Terms or use it unlawfully.

Governing law
